Definitive Map Review 2011-13 Parish of Tavistock
Report of the Head of Highways and Traffic Management
|
The report examines the Definitive Map Review in the parish of Tavistock in the West Devon District.
2. Background
The original survey, under s. 27 of the National Parks and Access to the Countryside Act 1949, revealed twenty four footpaths, in which were recorded on the Definitive Map and Statement, Tavistock Urban District with the relevant date of 1 May 1958. In 1987 the parish of Tavistock Hamlets was abolished and three footpaths were transferred to Tavistock parish.
The review of the Definitive Map, under s. 33 of the 1949 Act, which commenced in the 1970s, but was never completed, produced no proposals for change to the map in the parish.
The Limited Special Review of Roads Used as Public Paths (RUPPs), also carried out in the 1970s, did not affect this parish.
3. Review
The current Review began in September 2011 with a public meeting held in the Alexander Centre. Public consultation was carried out and the review was advertised in the parish and in the Tavistock Times.
The responses were:
County Councillor D Sellis - no comment
West Devon Borough Council - no comment
Tavistock Town Council - no comment
British Horse Society - no comment
Byways and Bridleways Trust - no comment
Country Land & Business Association - no comment
Open Spaces Society - no comment
Ramblers' Association - no comment
Trail Riders' Fellowship - no comment
Three proposals emerged from the consultation exercise and the previous abandoned reviews. Proposal 1, a Schedule 14 application for the addition of a footpath running between Chollacott Close and Whitchurch Down is being pursued by means of a creation agreement in preference to a modification order. However, if no agreement can be reached the matter will be the subject of a future report to this Committee.
The two other proposals relate to the diversion of Footpath Nos. 2 and 6 and are being dealt with under delegated powers.
4. Conclusion
It is recommended that Members note that there are no other proposals for modifying the Definitive Map in the parish of Tavistock. Should any valid claim be made in the next six months, it would seem sensible for it to be determined promptly rather than be deferred.
